KARACHI: An application for urgent hearing was field before Supreme Court by Director General Valuation, Collector Custom MCC East and Chairman FBR to hear a case about provisional release of imported goods under section 81 0f the Customs Act 1969 by Custom Authorities. Raja Muhammad Iqbal Senior advocate Supreme Court filed the application requesting fixation of the same on Dec 10 seeking hearing of a leave to appeal filed against an order of a division bench of Sindh High Court which ordered the Custom Officials to release the imported goods detained due to dispute over Valuation.
The bench while hearing a constitution petition CP-D 6918 of 21015 ordered the Custom Officials to release the good by themselves if the importer deposits the amount of difference between claimed value and assessed value. The order was passed as court saw an unprecedented number of petitions seeking benefit of provisional release.
The Pakistan Custom is resisting the order on legal ground that such release would make the matters more complex.
