KARACHI: A divisional bench of High Court of Sindh on Friday allowing a petition filed by Rising Sun Construction company ordered Custom officials to process the Goods Declaration manually as Weboc system is not available at National Logistic Cell Container Terminal.
Earlier the bench heard the arguments by counsel for the petitioner as well as respondent Pakistan Customs Appraisement, East. The respondents include Secretary, Chairman FBR, Collector Customs, Port Muhammad Bin Qasim (PMBQ), Collector Customs, Deputy Collector Customs, Assistant Collector Customs, Appraisement, East besides shipping line Maersk, QICT and NLCCT.
The petitioner maintained that company is engaged in construction work in Kashmir and Northern Area and for its activities imported 10 prime movers which arrived at PMBQ . The petitioners counsel said that it was clearly written on manifest, bill of landing etc that port of landing would be Port Qasim while imported goods are destined for Lahore Dry Port.
The goods were shifted from PMBQ, QICT to NLCCT by mistake of the shipping line. The goods were stuck-up as respondent Customs department raised objections and queries one after another and disallowed the release on ground that Weboc is not available at NLCCT.
Kashif Nazeer advocate said that it was a case of hardship and that rules do not permit the release of items even if landed mistakenly.
If the court allows this petition as a case of hardship, we have no objection, submitted Kashif Nazir . The bench allowing the petition ordered manual processing of the imported goods against assessment and payment of custom duty and other levies.
