KARACHI: An appellate bench of High Court of Sindh (SHC) remanded a case back to the Custom Appellate Tribunal with the direction to decide the matter in one month time from the date of receipt of order.
The bench was hearing a Special Custom Reference Application filed by Pakistan Customs MCC (Preventive) Karachi.
Khalid Rajpar Advocate appearing for the petitioner maintained that tribunal while hearing an appeal by Mst Amina Bint-e-Imam Baksh passed an order which is not reasoned.
The bench found the argument to be correct and observed that it is in violation of the Section 24 of the General Clauses act.
The bench held that in the circumstances it is in the interest of justice that matter be remanded back to the tribunal for determination on merits through a well reasoned speaking order.
