KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Abdul Malik Gaddi and Justice Mehmood A Khan dismissed an application filed by Pakistan Customs seeking stay of refund of security deposited by importers as per judgment in a case of enhancement of value by the DG Valuation in violating of section 25-d of the Customs Act 1969.
The customs filing the application maintained that they have filed an appeal before Supreme Court against judgment by SHC bench and till decision of appeal, Nazir of SHC be asked not to refund the money of importers.
The counsel for importers opposed the application and said despite filing two applications for an urgent hearing, the respondent department failed in getting any relief from the apex court and as the judgment is in field, Nazir cannot be stopped from refunding the security deposited by the petitioners/importers.
The bench agreeing with the arguments by petitioners/importers side dismissed the application.
As a result, importers are getting refund which amounts to 20-25 crore rupees.
