KARACHI: Justice Muhammad Shafi Siddiqui of High Court of Sindh on Thursday ordered release of consignments of plaintiffs on payment of differential amount.
The bench earlier heard counsel for plaintiffs Sama Traders, Idrees Steel and Haider Industries who filed a suit against Chairman FBR, Director General Valuation, Chief Collector Customs of MCC and Collector Customs, East regarding assessment of value in respect of Steel Bars
The counsel cited a number of identical cases and sought an identical order. Masooda Siraj and Kashif Nazeer Advocates appearing for the Custom Officers confirmed that suit is identical in nature and a similar order could be passed.
The plaintiff prays to the court to declare the method adopted by the Customs department in reaching the price of prime newly produced hot rolled alloy deformed bars as out dated, arbitrary and to order them to pass a new valuation ruling.
The bench however after hearing the counsel ordered the plaintiff to pay the differential while custom officers were ordered to release the consignments immediately. The bench also ordered that controversy be decided within six weeks.
