KARACHI: A custom appellate bench of High Court of Sindh dismissed a SCRA filed by Heal Pharmaceuticals (pvt) Ltd, Peshawar against Collector of Customs through Sardar Faisal Zafar Advocate.
As per details a Show Cause was issued to the applicant after release of consignment on 3-12-2018 on charge of mis-declaration vide Order in Original 658/2018-19 dated 9-1-2019. The appeal preferred was also rejected by the Custom Appellate Tribunal against which the instant SCRA was filed.
The counsel for applicant argued that correct declaration was filed lower for a did not appreciate the evidence in proper perspective.
The bench said that in revision jurisdiction, this court cannot appreciate or go into the questions of facts and its role is limited to only the questions of law. It held that as no question of law arises out of reference application and request for “de-novo” appreciation of facts is beyond jurisdiction therefore the SCRA is dismissed in Limine.
