KARACHI: As many as 16 Special Custom Reference Applications (SCRA’s) were remanded to the Special Customs Appellate Tribunal (SCAT) by a Customs Appellate bench of High Court of Sindh here on Monday.
The reference bear No’s 132-147 of 2014 and pertains to the holding of a consignment of CNG cylinders meant for storage. The SCRA’s impugned order dated 18-11-2013 passed in Custom Appeals K70/2013 and others identical in nature.
As the appeals were taken up, Khalid Rajper advocate appearing for the Appellant, Collector of Customs placed an order of Supreme Court of Pakistan dated 27-01-2020 in Civil Appeal No 716/2014 setting aside judgment dated 05-03-2013 in CP-D 4320 of 2012 and others through which impugned Show Cause Notices dated 19-11-2012 were set aside.
Khalid Rajper further contended that Special Customs Appellate Tribunal decided the appeals under the said order which now stands set aside by the apex court. In view of the apex court order, these SCRA’s be allowed by remanding the matter to the Tribunal for decision on merit, submitted, counsel for Custom Collectorate.
The bench after hearing arguments and perusing orders of the Supreme Court remanded the matter to Tribunal for deciding the same on merit in terms of section 196 (5) of the Customs Act 1969.
