KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Friday adjourned hearing of a petition seeking release of a land cruiser.
The petition was filed by Fayyaz Ali Mirani through counsel Miss Dil Khurram Shaheen Advocate citing Directorate of Customs Intelligence (DIT) as respondent. The counsel contended that the respondents are not implementing the order of the tribunal which is in favour of the petitioner.
Haider Ali Shaikh advocate appearing for the DIT said a Special Customs Reference Application has been filed by the department against tribunal’s order. He submitted that impugned order was passed by a single member bench of Special Customs Appellate Tribunal while under the law, a double member bench alone can hear and decide such appeals.
The bench after hearing initial arguments adjourned further proceedings till April 30.
