KARACHI: Pakistan Customs,Valuation, on Tuesday, filed two Special Custom Reference Applications (SCRA’s) impugning an order passed by Special Customs Appellate Court in RP Relay import case.
The appeals were filed through Masooda Siraj and Zafar Hussain Advocates on behalf of Collector Customs, Port Muhammad Bin Qasim (PMBQ), Customnews.pk learnt. According to details, Sonia International imported a consignment of R.P.Relay 220 Volt of different specifications, Pipe Cutter, Flaring Tool Sets, Fan brackets and 100 per cent copper fan motors 5/33 watt each from China. The imported declared a value of US $ 0.17 to 0.30 per kilogram.
The customs assessed the goods to be valued between US $ 1.02 to 7.1 per kilogram and raised the demand for custom duty and taxes as per assessment. The importer challenged the said order before the Collector Adjudication who dismissed the appeal. The importer then filed the appeal before Customs Appellate tribunal, which was allowed on ground that assessment was in violation of section 25 of the Customs Act 1969 as the respondent officials made direct assessment ignoring sequential method.
The second issue in favour of the appellant was that the assessment order was passed after the mandatory period of 6 months and was done after ten days of mandatory time.
The SCRA’s filed today challenges the order of the tribunal.
