KARACHI: A constitutional petition filed by Muhammad Hanif Jiwani seeking order of restraint against Pakistan Customs to not to register a First Information Report was dismissed by a custom appellate bench of High Court of Sindh.

The bench at the outset confronted the counsel for petitioner regarding maintainability of the petition but no justification came forth. The bench observed that a department cannot be stopped from performing public duty and that too on a mere apprehension. The bench said that no need for any interference is available and termed it “misconceived”.

“Even if an FIR is registered, statutory remedial recourse is available to the petitioner and no case is made out to sanction the direct recourse to of the petitioner preferring proceedings before the civil tax bench of this court”, the bench held dismissing the petition in- Limine.
