KARACHI: Hearing a petition filed by Five Star Enterprise Karachi and Red Rose International, importer of gum products, a custom appellate bench of High Court of Sindh ordered that a responsible officer from Collectorate of Custom concerned shall be in attendance on 26-1-2023, next date of hearing.
The bench earlier heard Rana Sakhawat Advocate representing the petitioner companies. The counsel submitted that after introduction of 3rd provisio to Section 81 of the Customs Act 1969, the custom authorities cannot allow provisional release in case of a valuation dispute.
Rana Sakhawat Advocate maintained that Valuation Ruling 1695/2022 dated 18-11-2022 has been challenged in a review application which is pending while the petitioners are burdened by port charges.
The bench after hearing the counsel ordered provisional release if petitioners pay undisputed amount before Collectorate and secure the disputed amount before the Collectorate by way of a Pay Order/Bank Guarantee.
