KARACHI: A custom appellate bench of High Court of Sindh headed by Justice Junaid Ghaffar allowed provisional release of consignment of M/s Nutri Food & Pharmaceuticals.
The bench earlier heard counsel from law firm Franklin Law Associates representing the petitioner company who submitted that the petitioner is aggrieved by the Valuation Ruling No 1725, dated 9-1-2023 which has been challenged by way of a Review Application under Section 25-D of the Custom Act 1969. He further submitted that pursuant to provisio under section 81 of the Custom Act, department has been restrained from allowing provisional release in such cases.
The counsel from Franklin Law Associates drew the attention of the court to an order passed in CP- D7830/2020 ad-interim orders have been passed.
The bench after hearing at length observed that in the circumstances, by way of an interim arrangement and until further orders, the respondents may determine disputed amount of duty and taxes and petitioner shall deposit the same with the concerned collector by way of a separate Pay Order or Bank Guarantee while remaining amount may be paid to the concerned collectorate. The bench ordered release of consignment once the amounts are secure and deposited.
The bench then adjourned further proceedings till Jan 26.
