KARACHI: The notices for recovery of duty and taxes issued to an importer from Lahore, Messers Noor Brothers was vacated by a custom appellate bench of High Court of Sindh as department failed to comply with the codal formalities.

The importer moved the High Court through law firm Franklin Law Associates. A counsel from the law firm arguing the petition maintained that demand notices creating certain demands are illegal, un-called for and without jurisdiction.

He further submitted that no adjudication proceedings were intiaited and no opportunity of hearing was provided before issuance of impugned notices.

The departmental representative did not controverted the contentions at which the bench vacated the notices while setting the department at liberty to initiated  proper proceedings if they have some material and such proceeding shall be subject to limitation and fulfillment of codal formalities.
