KARACHI: Hearing a petition filed by Messers Inverse Power Solution against Secretary Revenue, Chairman FBR, Collector MCC Appraisement & Facilitation East, Stated Bank of Pakistan (SBP), Habib Metropolitan Bank Limited, Bank Islami, SNS Shipping Agency, Sharaf Shipping Agency and IAL Pakistan, Justice Adnan Choudhry of High Court of Sindh ordered issuance of notices to official respondents for Sept 08.
The petitioner was represented by Franklin Law Associates who challenged the jurisdiction of State Bank of Pakistan (SBP) challenging two circulars/EPDs issued on different dates. The counsel from law firm submitted that SBP is attempting to regulate the import of Solar Panels and Solar Invertors. It was argued that import of these items is regulated by Customs Act, Import and Export (Control Act) 1950 and Import Policy Order 2022.
The petitioner prays to court to declare impugned circular namely EPD Circular No 9/22 dated 20-5-2022 and EPD Circular No 11/22 dated 05-07-2022 are without jurisdiction and therefore illegal and further declare that even other wise these cannot be implemented with retrospective effect.
The bench after hearing initial arguments ordered issuance of notices to the official respondents for Sept 08.
