KARACHI: Hearing a petition CP-D-6300 of 2021 filed by Messrs Build Trade against Chairman F.B.R and Collector Customs, MCC, A & F, East, a custom appellate bench of High Court of Sindh ordered issuance of TP GD against post-dated cheques/bank guarantee.
The bench earlier heard Aqeel Ahmed Advocate, counsel for petitioner company who maintained that consignments imported by the company have been held on the basis of some administrative instructions/directions issued by the F.B.R. He expressed willingness of the company of furnishing post dated cheques and security with respect to disputed amount so that TP GD is issued enabling the importer to take goods to designated dry port.
Khalid Rajpar advocate, counsel for the collectorate concerned argued that various CGOs do not permit the release of these TPs as the goods belong to PATA/FATA.
The bench after hearing the side formed the opinion that there is no impediment in issuance of TP if the petitioner company secures amount of duty, taxes by way of depositing post-dated cheques or furnish bank guarantee.
The bench allowing the petition ordered the Nazir of SHC that once amount is secured he shall issue a certificate to Custom authorities who in turn would issue TP after filing of GD enabling the petitioner to take the goods to dry port area concerned. The bench ordered both the custom authorities as well as the petitioners to abide by the CGOs issued by the F.B.R time to time.
