KARACHI: A customs appellate bench of High Court of Sindh (SHC) dismissed two constitution petitions filed by importers Muhammad Aslam and Muhammad Sohail directing them to solve the issue by contesting SCRA’s.

The bench was hearing two petitions 4233 and 4234 of 2021 and Special Custom Reference Applications 550 and 551 of 2017 filed by customs department.

The bench perusing the record observed that petitioners filed appeal before the appellate tribunal which were decided in their favor against which SCRA’s have been filed. In our view, the matter pertains to determination of certain questions of law raised in the SCRAs by the department and if the said questions are decided that would resolve the  controversy between the parties. We therefore under the circumstances, direct the office to issue notices to the respondents in the SCRAs, the bench said in its order. The bench also disposed of the connected petitions observing that these were filed as counter blast to the SCRAs. They were directed to contest their view points in the SCRAs in accordance with law.
