KARACHI: A customs appellate bench of High Court of Sindh (SHC) adjourned hearing of a High Court Appeal (HCA) by manufacturer of famous brand Dettol praying the court to decide that whether it is a drug and falls under the jurisdiction of Drug Regulatory Authority of Pakistan (DRAP).

Haider Ali Khan advocate appeared in the High Court Appeal against order of single judge which remanded the issue of nature of Dettol to DRAP which did nothing for long hence forcing the appellant to file the instant HCA.

Opening the arguments, the counsel submitted that Dettol was not declared a drug under DRAP Act 2012 or rules promulgated there-under. It was further contended that suit was disposed of in a summary manner. He further contended that disposal order was not an order by consent of the petitioner and even proper reasons were not recorded.

The petitioner moved the DRAP authorities forĀ  implementation of order of SHC but no action was taken by the defendants. He said that petitioner is paying Sales Tax treating it as non drug outside the jurisdiction of DRAP. The bench after asking potential questions adjourned further proceedings to an unspecified date.
