KARACHI: Pre-admission notices were issued for 20-3-2020 by a division bench of High Court of Sindh (SHC) in a petition filed by Khadija Hashmi & Co which imported porcelain tile from China.
The bench comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan earlier heard Manzar Hussain Memon advocate from law firm Franklin Law Associates who submitted that it imported a consignment of porcelain tiles from China by declaring correct transaction value after completion of all codal formalities, however respondents intends to apply Valuation Ruling No 874/2016 dated 22-6-2016.
The importer has already filed an application under section Customs Act 1969 for revision of that valuation ruling before the Director General of Customs Valuation, Karachi however no order has been passed thereon, the counsel submitted.
The petitioner requested for provisional release of the consignment. Petitioner is willing to secure disputed amount of duty and taxes before the concerned collectorate in the shape of pay order/bank guarantee. The counsel relied on an order in a petition filed by Hilal Impel & others.
The bench after hearing at length ordered issuance of pre-admission notices to respondent custom officials as well as Deputy Attorney General and ordered that petition be fixed with connected petitions. The comments were also called and in the meanwhile request for provisional release be considered on securing disputed amount of duty and taxes.
