KARACHI: Preadmission notice was issued to the Chairman FBR, Collector, Model Customs Collectorate (MCC), West, Assistant/Deputy Collector MCC West for Dec 05 in a petition filed by Shoaib Enterprises against refusal to change the name of consignee.
Rayan Zia and Imran Iqbal advocates appearing for the petitioner company submitted that custom authorities are not allowing amendment in the IGM (Import General Manifest) in terms of section 45 (2) of the Customs Act 1969. They maintained that shipping line has allowed the change in consignee name, issued NOC and BL was also modified as required but custom authorities are declining the request to change the name of Bilal Engineering and Trade (importer) in the name of Shoaib Enterprises and no reason was assigned for such denial.
The counsel said petitioner apprehends that respondents will make an adverse inference .They relied on a judgment passed by the SHC (Saiban International versus Federation of Pakistan) and said there case is covered under the cited judgment.
The bench after hearing the arguments from lawyers of law firm Expert Law ordered issuance of pre-admission notices for Dec 05. The bench also directed the respondents to consider the request of the petitioner in terms of section 45 (2) strictly in accordance with law keeping in view the judgment relied upon by the petitioner side.
