KARACHI: Notice was issued to the Pakistan Customs as well as other respondents for Nov29 in a petition filed by Zarghoon Enterprises seeking release of Asphalt Paver machine used for construction of roads.

Ms Dil Khurram Shaheen advocate appearing for the petitioner side argued that the importer/petitioner argued that GD was filed under PCT heading 8479.1010 as it was freely importable. The said machinery was not hit by items listed in Appendix C of Import Policy Order 2016, she maintained adding that no certification of PSI was also warranted under the existing law.

The custom authorities of Port Qasim and West earlier allowed the release but now they including East Collectorate are resisting the release, she submitted adding that department has sought a clarification from Ministry of Commerce. The said letter/clarification was after the petitioner imported the item hence was not hit by any restraining order, she contended praying the court to order release of the consignment.

The bench however after hearing the petitioner side ordered office to issue notices to the respondents for Nov 29.
