KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Irfan Sadaat Khan and Justice Muhammad Humayun Khan on Wednesday disposed of a constitution petition filed by Haji Razzak Haji Habib Janoo, an importer of skimmed milk.

Adnan Motan advocate represented the petitioner while the Directorate of Valuation was represented by Masooda Siraj and Kashif Nazeer advocates. The respondent Syed Kareem Adil, Assistant Collector, Pakistan Customs, MCC East, Group I submitted a written statement stating that the assessment of the Goods Declarations have been completed  and the petitioner has accordingly made the leviable amount of duties and taxes directly to Collectorate and in view of thereof differential amount  seemed with Nazir in the shape of pay orders in respect of the two GD’s may be released to the petitioner.

The controversy pertains to the valuation of the skimmed milk. The petitioner maintains that Customs Valuation was assessing his consignment under VR 696/2014 at a rate of US $ 4000 while the  said VR lapsed on 1-1-2015. According to the petitioner this fact was brought into the knowledge of the Director General Valuation with a request to issue a new VR. The petitioner also maintained that new VR was necessitated as the value of imported consignment has fallen in international market to US $ 2650 per metric ton.

Today the bench after perusing the written statement by the Customs and as the petitioner counsel did not pressed the petition disposed of the same.
