KARACHI: AN appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abul Maalik Gaddi on Monday issued notice to Fairdeals Textiles (Pvt) Ltd for Oct 03 in a Special Customs Reference Application (SCRA) filed by Model Customs Collectorate (MCC), Export, Bond Section.
The applicant filing the reference maintains that as export oriented unit, respondent Fairdeals under SRO 327 of 2008 was bound to export 80 per cent of the items manufactured at the unit.
The applicant also maintains that in case of failure to meet the conditions given in SRO cited above, the Customs has the powers to raise demand for custom duty, Sales Tax, Income Tax and other levies and thus MCC Export has acted within four corners of law when they asked the respondent mill to pay Sales Tax.
The applicant assailing the judgment by the tribunal in favour of the respondent textile mills maintained that it has powers to raise demand for payment of duty and taxes if the SRO 327 0f 2008 is violated.
The bench after hearing initial arguments by Masooda Siraj advocate assisted by Zafar Ahmed advocate representing the MCC Export ordered issuance of notices to respondent mill and others for Oct 03.
