KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Tuesday allowed a constitution petition filed by Shaikh Pipe Mills against Anti Dumping Duty imposed on steel products.

Khalid Javed Khan advocate appearing for the petitioner company submitted that he is seeking release of goods at payment of the impugned duty against solvent surety with the Nazir of the court.

He submitted that court could allow the collection of the anti dumping duty in the same manner as custom duty is collected. He stated that he is seeking the remedy of challenging the anti dumping duty imposed on his consignment before the National Tariff Commission. The second forum is tribunal after which I have to come back to SHC for a relief, he submitted.

The counsel for Pakistan Customs and other respondents opposed the plea and said that anti dumping duty has been imposed on Jan 13, 2016 to protect the local industry. The bench however after hearing the counsel for petitioner disposed of the petition directing the respondents to release the consignment of Cold Rolled Steel Sheets in Coils after petitioner furnishes security to the satisfaction of the Nazir of the court.
