KARACHI:- A division bench of High Court ofSindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Muhammad Junaid Ghaffar on Wednesday ordered release of consignment against payment of deferential amount of custom duty and other taxes.

The bench earlier heard counsel for petitioner Imperial Furnishers who made  the Director Valuation and Collector Customs, Appraisement, West respondents in the petition.

The counsel maintained that instead of assessing the imported goods on declared value, Custom officials are assessing the goods under Valuation Ruling 765/2015 which is arbitrary and on very higher side. The petitioner maintains that during the process of determination of new valuation ruling , the analysis of data, market inquiry none finds mention in the valuation ruling.

The petitioner prays to the court to declare the VR 765 of 2015 as arbitrary and illegal, declare petitioner is not liable to pay duty etc.

The bench also heard counsel for the Pakistan Customs and later ordered that detained goods be released if the petitioner pays 50 per cent amount of custom duty as differential amount.

The petitioner has imported polyester furnishing, curtain furnishing fabric, flocking and velvet, curtain catalogue and sample book.
