KARACHI: Justice Nadeem Akhtar of High Court of Sindh (SHC) on Tuesday dismissed an application by Pakistan Customs to become intervenor in a liquidation proceedings pertaining to Kamoke Power Plant.
The Collector Customs MCC, Appraisement, West filed the application for recovery of the custom duty and other taxes. It was maintained by Masooda Wahab advocate that owner is legally bound to clear the goods from Custom charge after payment of leviable duties and taxes in view of section 83 (1) and 202 of the Customs Act 1969.
The owner imported assorted parts and components for 70 MW Track Rental Power Plant at Kamoke, Punjab. The owner/ importer sought exemption from duty and taxes on the basis of tax policy for power plants.
The project failed and the company went into liquidation. Today the bench dismissing the application by the Pakistan Customs to be joined in the liquidation proceedings however asked them to approach the liquidator andraise the department’s claim of custom duty and others taxes from the left over money if any.
