KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Sajjad Ali Shah and Justice Muhammad Junaid Ghaffar on Thursday ordered Pakistan Customs to release goods imported by Muree Brewey, Rawalpindi giving them benefit of section 81 of Customs Act 1969.

I have not seen that what is the consignment, said Masooda Siraj Advocate, counsel for Customs opposing the plea by the counsel for Petitioner Company.

The issue is of valuation ruling which has expired as ninety days period exhausted. We have challenged the Valuation Ruling and respondents are bound to issue a new ruling, he submitted. According to the petitioner Aluminum cans containing the basic ingredient for drink made by the importer company have landed at the port and detained due to dispute over valuation. The chairman FBR, Director General Valuation, Collector Custom Port Muhammad Bin Qasim and Collector Appraisement are cited as respondents in the petition.

The cans are of different size containing 250, 300, 330, 355 and 500 ml and said to be imported/originated from Romania, Italy, China and Turkey.

The bench after hearing the sides ordered that if a case under section 81 of Custom Act is made out, Custom should release the consignment on payment of differential amount pending decision of the review application against impugned Valuation Ruling.
