KARACHI: An appellate bench of High Court of Sindh comprising Justice Irfan Saadat Khan and Justice Muhammad Humayon Khan on Monday ordered Customs to treat a petitioner at par with five other petitioners whose vehicles were impounded for carrying smuggled diesel.

Ms Dil Khurram Shaheen advocate appearing for the petitioner Abdul Sattar Brohi in Constitution Petition (CP-D 4456 of 2016) and respondent in Special Customs Reference Application (SCRA 457 of 2016).

The counsel at the outset stated that the custom officials have released five vehicles out of six and only petitioner/respondent was being discriminated. She submitted that the tribunal has ordered in favour of the petitioner but this order was not being implemented.

Kashif Nazeer Advocate appearing for the Customs department said that order was not implemented as the SCRA has been filed and is pending.

The bench expressed annoyance over non implementation of the orders of the tribunal and also observed that when five out of six vehicles impounded were released why not the sixth one was also not released.

The bench then ordered similar treatment to the petitioner and directed the custom officials to gave similar treatment to the petitioner. The bench also tagged all the four connected SCRA’s and the petition while putting of further hearing to a date to be fixed later by the office of the court.
