KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M. Shaikh on Friday issued notices to Special Customs Appellate Tribunal and Sunshine Company for Aug 11.

The bench was hearing a Special Customs Reference Application (SCRA) 829 of 2016 filed by Director, Intelligence and Investigations, Pakistan Customs against an order passed by the Customs Appellate Tribunal in an appeal  657 of 2014 dated 15-12-2014,

The Special Customs Appellate Tribunal passing an order under section 194-B of Customs Act 1969 partly allowed the appeal filed by Sun Shine Company and ordered release of a Hino Oil Tanker which was confiscated/detained after recovery of 35000 lites of smuggled HSD. The  applicant DIT raised the law point that whether a vehicle used for smuggling certain goods can be released.  The order was in violation of  section 157 of the Customs Act 1969 and SRO 499 (1) of 2009, the appellant/applicant maintains praying the SHC to set aside the impugned order passed by the respondent customs tribunal.

Today the bench after hearing initial arguments by the applicant/appellant side ordered issuance of notices to the respondents for Aug 11,
