KARACHI: Justice Agha Faisal of High Court of Sindh (SHC) rejected a suit/ plaint filed by Syed Irshad Ali  Shah a civil servant serving in the Pakistan Customs. Filed through Ovais Ali Shah Advocate, Plaintiff challenged his transfer.

Khalid Rajper Advocate appearing for the department challenged the maintainability of the suit on ground that Plaintiff has efficacious remedy before Federal Services Tribunal.

The counsel for Plaintiff attempted to argue that SHC can hear and decide the suit.

The SHC bench after hearing the sides held that grievance raised by the Plaintiff could not be adjudicated in a civil suit in view of bar contained in Article 212 of the Constitution as already decided by the Supreme Court of Pakistan.

The bench then rejected the plaint.
