KARACHI: Hearing another constitutional petition regarding imposition of Customs value on higher side by ordering enhancement of customs value beyond jurisdiction, an appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Arshad Hussain Khan on Tuesday allowed release of a consignment of baby diapers.

The bench earlier heard Talal Tariq Khursheed advocate of Franklin Law Associates representing importer Spectrum Enterprises. The counsel referred to the order passed by SHC bench in Constitution Petition (CP) 4790/2016 and submitted that issue in question is identical to one raised in dozens of petitions which are pending adjudication by the same bench.

The counsel prayed  that the consignment, subject matter of this petition could be released provisionally as per terms of the order passed in earlier petition wherein importers were asked to deposit the differential amount between declared and assessed value is deposited with the Nazir of SHC.

The bench allowed the request and ordered release on payment of custom duty, taxes to the department with differential amount secured before Nazir of SHC.
