KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Abdul Malik Gaddi on Wednesday adjourned hearing of a Special Customs Reference Application filed by a clearing agent on the request of counsel for Collector Customs ,Model Customs Collectorate (Exports), WeBOC.

Earlier Iqbal Khurram advocate appearing for the respondent department filed power and said he has not received the copies of the SCRA and other documents, annexures relied upon by the applicant. The bench asked the applicant to provide copies to the respondent side. The counsel for applicant also drew the attention to the court about an application for interim relief against order of Special Customs Appellate tribunal which dismissed appeal filed by Nisar Ahmed and Co.

The bench permitted the applicant to file an application for an urgent hearing and said if filed it would be heard on its own merit. According to applicant he filed a duty draw back claim of rupees 16528 in one case. The JS Bank declared the  Form “E” and BCA as fake after which the Custom authorities issued show cause to the applicant which was then challenged in Custom hierarchy and later before Customs Tribunal but lost everywhere.
