KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Justice Muneeb Akhtar and Justice Abdul Malik Gaddi on Monday allowed an application for restoration of an Income Tax appeal dismissed for non-prosecution.
Sohail Muzaffar advocate, counsel for Suriya Textile Ltd, manufacturer and exporter of textile made up and terry towels moved the application mentioning that he is suffering from “Vertigo” and on 9-9-2015 he was later by 5 minutes. When he came to the court he was told that his appeal has been dismissed for non prosecution.
Citing the personal reason , he prayed to the court to restore the said appeal.
Today Amjad Iqbal advocate appearing for Sales Tax department raised no objection on ground that personal illness of the lawyer for appellant is raised.
The bench after no objection by the counsel for defendants/respondents allowed the application and while restoring the appeal fixed May 24 as next date of hearing .The appeal pertains to levy of an additional Sales tax and penalty amounting to rupees 1923, 226.
The appellants questions the manner in which Sales Tax was recovered from companies account and disputes show causes notices given to him on alleged charges of selling finished products to non registered purchasers who then evaded duty and taxes including Sales tax.
