KARACHI: A constitutional bench of High Court of Sindh comprising Justice Agha Faisal and Justice Abdul Mobeen Lakho dismissed a constitutional petition filed by importer Majid Hussain against custom officers.
As per details the petitioner imported a consignment in January this year which remained at Port. After expiry of free days the petitioner applied for change in the name of consignee but no release was sought. The said application was decided on 18.04.2024 and even thereafter petitioner did not make any move until the instant petition was filed.
Muhammad Faisal Qasmi Advocate, counsel for the petitioner, when confronted with inaction on part of the petitioner was unable to give any explanation. Meanwhile Sardar Zafar Hussain Advocate representing the respondent custom officials including Usra Rasool Assistant Collector, MCC (West) and AO of SAPT filing vakalatnama raised objection over maintainability of petition on account of laches.
The bench after hearing the sides at length dismissed the petition.
