KARACHI: Hearing a Special Customs Reference Application (SCRA) filed by Directorate of Intelligence & Investigations (DIT) against Unilever Pakistan and Customs Appellate Tribunal Karachi, a custom appellate bench of High Court of Sindh suspended the judgment dated 15-4-2024 while issuing notices to the respondents. Khalid Rajper advocate appeared for the applicant department.

The case pertains to clearance of BELSIL UL 630 MS under PCT Heading 3910.0000 declared as primary silicon. The DIT blocked the consignments at Gat Out stage. The samples were drawn and sent to HEJ Laboratory which confirmed the imported item to contain 56.22 per cent  Poly dimethyl Silicone and 30.81 per cent Silica and the preparation fell under PCT 3824.9999 on the basis of constituents.

The Customs Appellate Tribunal hearing appeals filed by the importer as well as clearing agent set aside the Order in Original and allowed release against which the instant SCRA was filed.

The High Court bench today after a brief hearing and going through the questions of law involved ordered issuance of notices to the respondents for a date to be fixed by the office of the court while suspending order of the tribunal.
