KARACHI: A division bench of High Court of Sindh suspended an order passed by the President Secretariat (Public) and Federal Tax Ombudsman while hearing a constitutional petition filed by Federal Board of Revenue through Collectorate of Customs, SAPT (South Asia Pacific Terminal).

The respondents include Ministry of Law & Justice Division, President of Pakistan  through Consultant (Legal Affairs), FTO and Mr.Amanullah Shaikh of Davis  Pharmaceutical Laboratories. Sardar Zafar Hussain advocate appeared for the petitioner.

The petition impugnes order passed by President Secretariat (Public) dated 12.08.2024 and order passed by FTO in complaint No 5769/ISB/CUST/2023.

Sardar Zafar advocate argued that FTO had no jurisdiction in the matter, as the Petitioner has made assessment of the subject goods and a concession claimed was denied for want of entitlement. He said that not only the complaint was allowed but such order was up-held by the President Secretariat on ground that no one appeared on behalf of the Petitioner. He submitted that no notice in respect of hearing of the case.

The bench after hearing the counsel for petitioner FBR ordered its office to issue notices to the respondents as well as Deputy Attorney General for Pakistan.
