KARACHI: The provisional release of goods imported by Anwar Trading Co was allowed by a custom appellate  bench of High Court of Sindh against securing of 100 per cent penalty with the Nazir of SHC. Imran Iqbal Advocate assisted by Aneel Zia represented the petitioner company.

As the petition came up for hearing, counsel for the petitioner submitted that controversy raised in this petition is already pending before this bench in a number of identical petitions including CP-D1145/2024, CP-D1748 and others wherein imposition of 100 per cent penalty introduced through Finance Act 2023 is under challenge and ad-interim orders are also in place.

The bench after hearing initial arguments ordered issuance of notice to the Respondents as well as Attorney General for Pakistan. The bench ordered that this petition be fixed with other identical petition. The bench as a measure of interim relief ordered that provisional release of goods be considered if the petitioner secures amount of peantly before the Nazir of SHC and compliance may be furnished on the next date of hearing.
