KARACHI: A High Court appeal filed by an importer of V-Belts against order of Single Judge of High Court of Sindh recalling interim order of restraint was dismissed by appellate bench.
Shahryar filed the appeal against Sheikh Muhammad Iqbal and another besides Directortate of Intellectual Property Rights maintaining the appellant has rights over registered trade mark “BLACKCLUBS”. It was further submitted that single judge has recalled the interim stay. The appellant also prayed to the court to pass interim orders for holding of goods till disposal of Suit No 1367 of 2021 from which present appeal has emanated.
The appellate bench after hearing the counsel for appellant, respondent importers and Miss Afsheen Aman, counsel for IPR Directorate dismissed the appeal holding that order of the single judge is well reasoned and therefore cannot be interfered with.
