KARACHI: Hearing a bunch of 32 Special Custom Reference Applications filed by different field formations of Pakistan Customs including Collectorate of Customs, East & West, Directorate of Valuation and Directorate of Intelligence & Investigations (I&I), a custom appellate bench of High Court of Sindh took serious notice of what it termed carelessly drafted references which burdens the court.

The respondents include M/s SEZ Ltd, Lahore, M/s UK Traders, M/s International Steel Ltd, Karachi and others. The SCRAs were filed through Mr. Faheem Raza Advocate while respondents are represented by former Attorney General Khalid Javed Khan.

The bench also noted that a number of questions of law were proposed but the same were not properly drafted. Neither the court is supposed to answer as many as a dozen questions in Reference Jurisdiction. The bench also held that it reflects on competency of the department in future if such questions of law are placed before this court.

The bench that in such a case cost will be imposed and reference will be dismissed for want of proper prosecution.
