KARACHI: A custom appellate bench of High Court of Sindh dismissed two bail application filed by an accused Custom Consultant Asad Iqbal Shaikh. The accused was represented by Aslam Bhutta Advocate while custom appraisement was represented by Khalid Rajper Advocate.

The applicant was accused of misdeclaration of description, tax evasion, non payment of Sales Tax and other levies in a number of GDs by misusing ID and Password of Multan Instituted of Diseases. The good of different nature were imported and shown as “Medical Equipment” which are freely importable and exempted from levies.

The bench was informed by the counsel for applicant that the bail plea has been dismissed by the Special Custom, Excise and Taxation Court. He submitted that the applicant / accused is neither an importer nor an authorized custom agent and has nothing to do with the consignments concerned.

The bench noted that accusations against the applicant are about 126 different consignments from different collectorates by mis-using the User ID of MIKD Multan. The bench also noted that accused has admitted that he has provided services to the MIKD against fixed charges.

The bench after detailed hearing concluded that no mala fide could be established on behalf of the custom authorities and applicant/accused himself has admitted that his personal e.mail has been used.

The bench then dismissed the bail pleas of the accused/applicant.
