KARACHI: A two member bench of Custom Appellate Tribunal accepted an appeal filed by M/s G&S Manufacturer, Faisalabad and custom agent SSI Brothers, Karachi against an order passed by Collector Adjudication II in respect of import of polyester fabric imported in year 2012.
The customs initiated proceedings against importer and clearing agent in 2016, four years after consignment was cleared holding Sharjeel Jamal partner of SSI Brothers as “Master mind” of alleged crime if getting consignments cleared on the basis of forged fabricated documents filed electronically and misdeclaring port/country of origin.
The custom Appellate Tribunal after hearing arguments from both sides allowed the appeal holding that proceedings against appelanta were infested with inherent legal infirmities and substantive illegalities during the heirarchy of Pakistan Customs.
