KARACHI: Hearing a constitutional petition filed by Messers Axiom Trading Incorporated, Karachi, a custom appellate bench of High Court of Sindh allowed the request made by the petitioner company.
Earlier Rana Sakhawat Ali Advocate appearing for the petitioner submitted that there goods have been detained due to dispute over classification. The issue is under challenge and pending before Adjudication Collector. He further submitted that the petitioner is ready to pay the differential amount of duties and taxes.
The bench noted that port charges and others are accumulating and therefore by way of interim relief, the request by the petitioner is reasonable.
The bench allowing the request asked the petitioner to secure the undisputed amount of duty and taxes with the Collectorate concerned while secure disputed amount with the Nazir of SHC who was directed to invest the same in some profitable entity.
The Nazir was also asked to issue a certificate after receiving the security amount and Custom officials concerned were directed to release the consignment forthwith on receipt of certificate.
The petition was disposed of with in terms above.
