KARACHI: A tax appellate bench of High Court of Sindh restrained Inland Revenue from coercive recovery of income tax from petitioner company messers Pak-Sat Private Limited Islamabad.
The bench earlier heard Gazain Zafar Magsi advocate appearing for the petitioner company while Rana Shakawat Advocate represented the Income Tax department.
The Federal Secretary Revenue, Commissioner Income Tax (Appeals-VII) and Additional Commissioner (Audit III) are respondents in the petition.
The counsel for the petitioner relied on an identical petitioner and order wherein appeal was pending before the Commissioner appeals while department is attempting to get the income tax payable deducted from the account of the petitioner company.
The bench after hearing the sides ordered the Commissioner of Appeal VII to decide the stay application of the petitioner within 15 days. Once the stay application is decided, the stay granted by SHC will presumed to be vacated.
Till then the Income Tax department was restrained from coercive recovery.
