KARACHI: The Commissioner of Appeals (I) of Income Tax Department was ordered to decide stay application filed by Al-Noor Sugar Mills within 15 days.
The order came from an appellate bench comprising Justice Irfan Saadat Khan & Justice Mahmood A. Khan which heard Manal Wasiq Khan, counsel for petitioner company. The counsel stated that an appeal has been filed before the Commissioner of Appeals (I) which is pending adjudication. He said that petitioner would be satisfied if directions are issued to the respondent Commissioner to take up the stay application if not the appeal, within shortest possible time.
Deputy Attorney General Kafeel Ahmed Abbasi appearing for the respondents waived notice and did not object to the request made by the counsel for the petitioner.
The bench disposing of the petition directed the Commissioner of appeals to hear and decide the stay application, if not appeal within 15 days from the receipt of this order. The bench also restrained the department from coercive action till decision on stay, appeal.
