KARACHI: A custom appellate bench of High Court of Sindh (SHC) allowed an adjournment request by Customs department regarding release of goods for exports.
The bench was hearing a petition filed by Messers ARA Detergents & Chemicals FZE besides a Special Customs Reference Application filed by the department. The counsel for petitioner side maintained that if remedy is sought under section 138 of the Customs Act 1969, then aggrieved party has to move the High Court directly either by filing a petition or a suit. The bench after hearing the sides observed that petitioner may be allowed to exports the goods subject to securing of bank guarantee.
The counsel for the department Dr. Shahab Imam assisted by Rana Sakhawat Advocate sought time to take instructions from the department. The bench allowed the request and adjourned further proceedings till Friday, Feb 25.
