KARACHI: The customs appellate bench of High Court of Sindh (SHC) will hear a petition filed by M/s Sara Industrial Chemical Co. VS Fed. of Pakistan and Others filed through Franklin Law Associates here tomorrow i.e Feb 18.
The bench on Wednesday issued notices to the respondent custom officials besides chairman FBR in the petition. The counsel from renowned law firm submitted that its consignment of a chemical used in ice cream as a stabilizer was restrained at the “Gate Out” stage on ground of misdeclaration in classification. He referred to an identical case of another importer in which through an Order in Original clarification was made by the Collector that the same compound fall rightly under PCT Heading 3824.9999 which has been declared by the petitioner. The counsel for petitioner also challenged the jurisdiction of the respondent to put hold on the goods of the petitioner at this stage.
The bench after hearing the sides ordered issuance of pre-admission notices to the respondents as well as Deputy Attorney General for Friday, 18-2-2022 with the directions to submit suitable answers to the above concerns of the petitioner in the form of a statement through an appropriate officer of the respondent customs department.
