KARACHI: A custom appellate bench of High Court of Sindh fixed Aug 31 to hear a petition challenging power of collectorate to re-calculate amount of fine etc once Order in Original is passed by Adjudicating Authority.
The bench was hearing a constitutional petition filed by Penta International through Zain Jatoi Advocate.
The counsel contended that an ONO was passed and under SRO 499/2011 redumption fine was imposed at a rate of 35 per cent.
The petitioner then approached the collectorate concerned for release of goods but it said it would re-calculate the amount of fine.
The bench after hearing initial arguments said that if petitioner seeks release, amount of fine shall be secured and if a decision on merit and powers of collectorate after passing of an ONO is sought then issue will be taken up and decided once comments are filed by the respondent directorate.
The bench later adjourned hearing fixing Aug 31 as next date to decide the powers of collectorate once adjudication proceedings are completed.
