KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Friday ordered Pakistan Customs to consider a request for sending samples of Pile fabric and provisional release of the item subject to securing disputed amount of duty and taxes before Collectorate concerned in the shape of pay order / cheque.

The bench was hearing a petition filed by A.K.International through Franklin Law Associates which imported a consignment of pile fabric from China used in manufacture of blankets.

The counsel from the law firm submitted that petitioner completed all codal formalities and declared value as per Valuation Ruling 1453/2020 dated 24-6-2020, however respondents are not assessing the same in terms of  Valuatiuon Ruling without assigning any reason.

The counsel prayed to the court to direct the respondents including Collector, Deputy Collector, Port Muhammad Bin Qasim and Director of Directorate General of Valuation to apply the Valuation Ruling in field or in the alternative, send the samples for testing to an independent Laboratory for testing and in the meanwhile the consignment be released provisionally.

The bench after hearing the petitioner side ordered issuance of notices to the respondents and fix the next hearing after two weeks. The respondents were also directed to consider the request of petitioner subject to securing of dispute amount of duty and taxes before the collectorate concerned.
