KARACHI: An auction of ball bearings by Pakistan Customs, Sukkur was stayed till further orders by an appellate bench of High Court of Sindh (SHC), comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan.
Khalid Traders, Lahore filed the petitions through Zia-ul-Hassan advocate challenging auction notice dated 19-2-2020. The counsel submitted that Order in Original was passed against the petitioner/importer which has been challenged before the Special Customs Appellate Tribunal but as double member bench is not functional, interim relief could not be obtained by the petitioner.
The bench after hearing the counsel for petitioner ordered issuance of pre-admission notices to the respondents including Deputy Collector, Customs (Preventive) Sukkur and Superintendent Custom State WareHouse, Sukkur for March 11. The respondents were restrained from auctioning the goods till next date of hearing while they were also asked to file comments by March 11.
