KARACHI: The Director General, Sindh Building Control Authority (SBCA) was ordered by a division bench of High Court of Sindh (SHC) comprising Justice Hasan Azhar Rizvi and Justice Zulfiqar Ahmed Khan to remove illegal construction if any going on at plot no 4-A-2-2 Nazimabad No 4.
The bench earlier heard Rizwan Ahmed Siddiqui advocate, counsel for petitioner who contended that the construction was contrary to approved building plan in violation Karachi Building & Town Regulations 2002. It was further contended that petitioner lodged complaint of such illegal construction with DG SBCA but no action has been taken so far.
The counsel for petitioner also contended that respondent no 6 is running a biscuit factory right behind the petitioners’s home on a residential plot.
The bench ordering issuance of notice to the respondents and Advocate General Sindh asked the DG SBCA to take appropriate legal action for removal of illegal construction on the aforementioned plot if the same is raised contrary to approved building plan and in violation of KBCA Regulations 2002 after affording full opportunity of hearing to all concerned. The bench also sought a compliance report within 30 days time.
