KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan restrained.

Imran Iqbal Khan of Expert Law Firm appearing for the petitioner submitted that a consignment of the petitioner consisting of “Harvester” parts was provisionally assessed on 9-11-2018 after which a pay order amounting to rupees 1,125,000 was submitted as security. Later the matter was referred to Director of Directorate of Valuation for determination of transactional value.

The petitioner approached the relevant collectorate for finalization of provisional but needful was not done.

The counsel submitted that six months period under section 81 (2) and (4) has expired, the petitioner applied for return of the pay order but learnt that respondents are intending to encash the pay order.

The bench after detailed hearing while ordering issuance of pre-admission notice for Dec 20 restrained the respondent MCC West and Director Valuation from encashing the pay order. The bench also sought comments from the respondent by next date.
